Let us first say it is against the state licensing law for real estate agents to draft legal documents. We may continue to assist our clients and customers in filling in the blanks of forms for offers to purchase and other types of forms. There are many complexities involved in lease/purchase that make it almost impossible for there to be one simple form that would be a fill-in-the-blank type document. Because of this, our company prefers the lease/purchase or the option to purchase documents be drafted by an attorney. We are able to offer guidance, direction and a service to our buyers and sellers while helping reduce their legal fees by getting the buyer and sellers; tenants or landlords to agree on several questions that need to be spelled out in legal document. Below are a few of many questions that may arise in a lease/purchase.

*What is the purchase price?
*When will closing take place?
*Will any of the monthly rental amount apply to the purchase price?
*If any of the rent does apply, will this be refunded if the buyer or seller defaults?
*Is there any earnest money or option money as part of this purchase?
*What happens if the house appraises low and the buyer cannot get a loan?
